Terms of Service

These Terms apply to AR Draw - Trace Anything ("AR Draw"), the website tooldraw.app and AR Draw Premium subscriptions. AR Draw is operated by its developer, an individual based in Vietnam ("we", "us"). Contact: support@tooldraw.app.

1. Agreement

These Terms are a legal agreement between you and us concerning your use of the AR Draw website and mobile applications (the "Applications") and the services available through them (the "Services").

By downloading, installing or otherwise using the website or the Applications, you confirm that you have read and understood these Terms and our Privacy Policy, which is part of these Terms, and that you agree to be bound by them. If you do not agree to these Terms, you may not use the Services.

2. Information collection and use; Privacy Policy

By using the Services, you consent that we may collect and use certain information about you, as described in our Privacy Policy. Use of the information we collect is subject to the Privacy Policy in effect at the time it is used.

3. Changes to these Terms

We may change these Terms at any time by posting a new version on the Services. You are responsible for reviewing these Terms from time to time. Your use of the Services after we post changes means you accept those changes.

4. Eligibility

By using the Services, you confirm that you are at least 18 years old. If you accept these Terms on behalf of a company, organization, educational institution or other entity, you confirm that you have the authority to bind it, and "you" refers to both you and that entity.

5. License

Subject to your compliance with these Terms, we grant you a limited, non-transferable, non-sublicensable, non-exclusive, revocable license to use the Services through the website or by downloading and installing the Applications.

When you get the Applications from an app store such as the Apple App Store (the "App Provider"), you acknowledge and agree that:

• These Terms are between you and us, not the App Provider.
• The App Provider has no responsibility for the Applications.
• If the Applications fail to conform to an applicable warranty, you may notify the App Provider and request a refund where applicable. The App Provider has no other obligation.
• The App Provider is not responsible for claims relating to the Applications or your use of them.
• The App Provider and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

6. Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our web orders. Paddle provides all customer service inquiries and handles returns. Purchases made on tooldraw.app are also subject to Paddle's Buyer Terms.

Purchases made inside the iOS app are processed by Apple and are subject to Apple's Media Services Terms.

7. Subscriptions

AR Draw Premium is offered as a monthly plan ($7.99 per month) or a yearly plan ($19.99 per year), plus any applicable taxes. Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time; access continues until the end of the paid period. Refunds follow our Refund Policy.

A Premium subscription bought on the web unlocks Premium in the AR Draw app through the activation link we email to you after purchase.

We may change, suspend or remove features at any time. If a change removes a feature you paid for, you may ask for a refund under our Refund Policy.

8. User content and copyright

You may import images or drawings into the Services. You keep ownership of your own creations, but by using the Services you grant us a limited license to process that content only to provide the Services.

You agree not to upload or use copyrighted, offensive or unlawful content. We may remove or restrict content at our discretion.

9. Disclaimer: educational purposes only

The Services are provided for educational and entertainment purposes only. The Applications help you practise drawing with augmented reality guidance. We make no guarantee of artistic results or professional outcomes.

10. Intellectual property

All intellectual property rights in the Applications and Services remain with us. You may not copy, modify, distribute, sell or lease any part of the Services without our prior written consent.

11. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms. On termination, the license granted to you ends immediately.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

13. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict of laws principles. This does not take away the protection of mandatory consumer laws in the country where you live.
